Archos, I think these are two different issues. Ferre can sue for Vita Imana because it was his song in that group album but Ferre cannot sue for his vocal on operational dragon because that was Werrason's song. This is the same with Brigade, he did not produce any song with werrason, what he had were vocals on a werrason's song. If copyrights worked like that then there is no single artist under the sun who owns copyrights to any song as whoever played a role can claim ownership. Brigade himself might not even claim copyrights because the instrumentalists who played on his vocal will also claim their share. Werrason who paid for that part of the vocal will also claim his share. In the end the whole thing will have no sane legal interpretation. What Brigade can claim is his salary if he was not paid and it has to be paid according to he contract he signed.

Bingo…publishing rights is the key here and instrumentalists/vocalists don’t get those unless they’re listed as songwriters or producers. French courts follow music law, so essentially Brigade doesn’t have a case.

Furthermore, who ever is advising him on this is giving him very bad advice and it will be detrimental to his career, which he barely has, if he loses.
How? how it will be dtrimental to his career?

Despite Brigade being in the right and me being a great fan of him he doesn't have much say in the dispute.
First the recordings recorded in the Studio are of the owner of the studio and then of the artist.
The recording becomes of the Artist who pubblishes the song when the record is published as a cd or as a digital song or of the label who funded the studio and the artist.
With that said Brigade never signed a contract with Quartier Latin and with Wenge Musica neither with Koffi and Werra so legally he doesn't have any claim on any recording he made with them because except for Code Pin where Brigade is credited as a songwriter there is no other song that Brigade can legally claim as his own given how he was part of the group and he didn't sign no contract Brigade asking royalties is like vocalists who gets contacted for a project and never sign a contract but later come to claim money, with Brigade is even worse because usually vocalists, songwriters, writers, sign a deal with the Singer or the label to get a percentage and Brigade never did this so even tho he want to calim royalty in a court of law he won't be credited with anything except for a legal serious case for his song Code Pin on Koffi's album with that said most of his cries are bought or taken by those little kids who work with Atalakus or Songwriters who give guys like Brigade and co cries so technically if we want to be clear those guys should be even more mad that they don't get any money of the success of the cries Brigade made but them as well don't have signed any contract so they don't have any chance to legally calim anything both from Werra or Brigade.

He didn't sign any contracts tho, if I tell you the numbers of the lotto and the day the lotto get announcede you play those nubmers and I haven't I have no rights to claim that win because you put the numbers on your own terms, even if I buy the lotto ticket and give it to you I won't habe any claims and as I have said most of Brigade's crie if not all are "stolen" meaning taking from street kids or bought by guys who sell cries, if Werra says 1 we haven't signed any contract but you benefited from tour and donors gifting you money despite me not being forced two
and 2 you claim those cries are yours but I know you purchased or straight taken them away from other people and you yourself decided to record under my group what Brigade will say?
For example there is a song that Brigade and Deplick made which was partially bought by the same songwriter who tricked them and sold to both of them the same song which was making like this "Nadia safula nga na koboya te" and was also having the lines of "dikidiki osalaki nga, tilelo mokusa ezo sila te,mwana mama atala abomi, domestic alambelaka ye/yo, c'est vrai nazalokola mbisi mayi ya moto nazokoka te eh mama? mama safula nga nakoboye te"

and Brigade pubblished it on 25th of March 2017
now what if Deplick claims Brigade stole his song or ask him royaltees cause he pubblished the song first? Deplick has more credibility for royaltees in this case then Brigade in his because as you can see they re 99% the same lyrics, but in the case of Brigade you partecipated on an album where you haven't signed a contract take or bought other people's lyrics but you now want to claim royaltees? It doesn't work like that
Don't get me wrong I am all for artist getting their rights and this was a very bad but smart move from Werra to never give credit except for Lobeso,Bercy, Bill and Celeo a song credited to their name but at the same time when you were a big artist like Brigade coming from QL you had to know your right a little bit and not be in the position to be scammed again, can you beleive that Prince asked for a contract by Werra? Prince so if Prince done it why Brigade couldn't do the same when he was way bigger and is still bigger then Prince?

I understand what you are saying but the premises remain the same: IF Brigade can prove those cris belongs to him. He has case.

Since he never signed a contract with Werra, Werra cannot claim that Brigade gave away his rights.

Brgade's lawyer will claim that the cri belongs to Brigade (they will need proof) and that Werra used the asymetry of power to rob Brigade of hs rights by not giving him credits.

And if you take into account that french judges always look at african work relationshps in a funny way, they might say that Werra abused his power to rob Brigade.

I'm not saying Brigade  gonna win but he has a path to victory.

Congolese musicians in bands need to know their rights plain and simple. The leaders have to stop being weird and stingy and actually pay their employees and song writers for what they contribute.
